EVA CODE Public Offer and Distance Selling Terms
Edition for customers whose transactions are subject to the laws of the Russian Federation. Document version: 28 October 2026. Effective date: 28 October 2026.
1. Definitions and seller information
1.1. Seller (Store Operator) means EVA CODE, the trading name of a seller registered in the Republic of Korea. Business registration number (사업자등록번호): 209-28-95980; representative: KIM VALENTINA. Seller's address: 경기도 안산시 단원구 별망로 555, 4층 420호, Republic of Korea. Telephone: +82 10-7652-8595; email: orders@evacode.co.kr. Further seller information is available on the Business Details page.
1.2. Website / Online Store means https://evacode.co.kr/, where goods, purchasing information and ordering facilities are provided.
1.3. Visitor means someone browsing the Website; User means a person using its features; Buyer means an individual purchasing, or intending to purchase, goods primarily for personal, family, household or other non-business needs; Recipient means the individual designated to receive a shipment.
1.4. Goods means cosmetic products and other merchandise offered on the Website; Order means the Buyer's selection specifying the goods, quantity, price, payment method and delivery address or method.
2. General provisions and legal framework
2.1. These Terms regulate ordering, distance sales, payment, delivery, cancellation, returns and complaints for consumers in the Russian market to whom the Seller offers products through the Website.
2.2. Where applicable to the relevant relationship, the governing requirements include the Civil Code of the Russian Federation (in particular Articles 435, 437, 438, 494, 497 and 1212), Russian Federation Law No. 2300-1 of 7 February 1992 on Consumer Rights Protection, including Article 26.1, and the current retail sale rules approved by Russian Government Resolution No. 657 of 30 May 2026.
2.3. The Seller's registration and location in Korea do not remove mandatory Russian consumer protections where Russian law applies. Website language alone does not establish the applicable jurisdiction. Mandatory rules of other relevant countries are not displaced by these Terms.
2.4. A product offer displayed on the Website constitutes a public offer where the law so provides. Statements about unavailability, delivery restrictions or the need to confirm an order are relevant only to the extent permitted by law.
2.5. The current Terms are made available on the Website. Changes apply to new orders from their effective date and do not retroactively disadvantage a Buyer under an existing contract. Mandatory legal rules prevail in the event of conflict.
3. Product information and prices
3.1. Before ordering, the Buyer is informed, to the extent required by law, of the product name and essential properties, manufacturer and country of origin, cosmetic ingredients and directions for use, quantity, expiration date, required conformity records, price, delivery options and other material terms.
3.2. The product price, delivery charge and total Order price are displayed before purchase confirmation. The settlement currency is shown at checkout; it must not be assumed that every payment is made in Russian rubles or automatically subject to Russian VAT.
3.3. Legitimate bank or payment-provider fees, currency conversion, import duties and destination-country taxes are disclosed to the extent legally required. The Seller may not impose compulsory charges that were not agreed upon after the contract was formed.
3.4. The price of an existing contract cannot be changed unilaterally. If a technical pricing or stock error is identified, the Seller contacts the Buyer, proposes legally available solutions and refunds any money received when an Order is cancelled. A published price does not give the Seller a unilateral right to revise an existing contract.
3.5. Discounts and loyalty schemes operate under the published terms of the relevant promotion. Changes to such schemes do not extinguish rights already accrued by the Buyer.
4. Placing orders and contract formation
4.1. The Buyer selects goods and quantities, chooses an available delivery option, provides necessary details, checks the price and confirms the Order through the action offered on the Website.
4.2. The contract is concluded at the time determined by the applicable rules for distance retail sales, taking account of acceptance, order confirmation and/or payment. The Seller sends a confirmation identifying the Order number, contents and agreed terms; it does not replace the Buyer's statutory rights.
4.3. The Order terms and the version of the offer in force at that time are retained to the extent necessary to perform the transaction and establish its terms, in accordance with personal data protection requirements.
4.4. If fulfilment becomes impossible due to unavailable goods, lawful shipping restrictions or failed payment, the Seller informs the Buyer and offers a lawful resolution: an agreed substitute, mutually agreed changes or cancellation with a refund of amounts received. Substitution without the Buyer's agreement is not permitted.
4.5. By placing an Order, the Buyer accepts the applicable terms of sale. This does not automatically constitute consent to marketing, public disclosure of personal data or optional cookies. Any legally required consent is collected separately.
5. Rights and responsibilities of the parties
5.1. The Seller must deliver goods of the agreed quantity, assortment and quality within the agreed period; provide mandatory information; respect statutory cancellation, return and complaint procedures; notify the Buyer of Order progress; and safeguard personal data in accordance with applicable law.
5.2. The Seller may request accurate information reasonably required for delivery or customs clearance, investigate documented signs of fraud and request an agreed advance payment where the payment arrangement was selected before contract formation. Checks must not be used to reject valid obligations arbitrarily or demand excessive documents.
5.3. The Buyer must provide accurate contact and shipping information, pay for the Order using the chosen method and comply with lawful carrier and customs requirements that were adequately disclosed.
5.4. The Buyer is entitled to reliable information, confirmation of purchase, goods of proper quality, statutory remedies for defects or delayed delivery, and the right to withdraw from a distance purchase within statutory time limits.
5.5. The absence of a cash receipt does not by itself prevent reliance on other evidence of purchase. A signature acknowledging delivery, or failure to note visible damage immediately, does not extinguish subsequent claims for hidden defects.
6. Delivery, transfer and customs matters
6.1. Goods may be shipped from the Republic of Korea using international carriers including Korea Post EMS, EMS Premium and available private carriers. Actual options, charges and estimated delivery periods are shown when ordering. Customs procedures and carrier operations may affect international delivery times.
6.2. The Buyer supplies the address, telephone number and legally necessary Recipient details and clarifies missing information when requested. Additional costs caused by an incorrect address or failed delivery are allocated according to applicable law and verified circumstances, not automatically charged to the Buyer.
6.3. Delivery is made to the designated Recipient through the agreed method. Delivery records and tracking information may evidence receipt. Risk of accidental loss or damage is allocated under applicable law and the actual handover circumstances; handing the parcel to a carrier alone does not necessarily discharge the Seller's statutory liability.
6.4. If a shipment is lost, damaged or materially delayed, the Seller reviews the complaint, seeks information from the carrier and fulfils its statutory obligations regarding delivery, refunds and lawful remedies. The Buyer may provide photos, video, correspondence or tracking information if available.
6.5. Import requirements, customs charges and taxes in the destination country apply in accordance with law, the Order terms and required disclosure. The Seller cannot guarantee the absence of customs inspections or transfer its own statutory duties to the Buyer.
7. Payment
7.1. Payment methods supported by the store are PayPal, Visa, Mastercard, Kaspi, Mir and bank transfer. Availability for a particular country or transaction, the currency and any conversion terms are shown at checkout.
7.2. Advance payment is required when expressly provided by the selected purchase option. For a bank transfer, account details and payment references are provided through verified EVA CODE channels; Buyers should not remit funds to banking details that the Seller has not confirmed.
7.3. Refunds are made to the original payment method or by another lawful method agreed with the Buyer, subject to provider capabilities and mandatory law. Banking procedures cannot lawfully worsen statutory refund deadlines or entitlements.
7.4. More details are set out on the Payment page. If documents differ, mandatory consumer rights and the terms specifically agreed before payment, insofar as legally valid, take precedence.
8. Cancellation, exchanges, returns and refunds
8.1. Where Article 26.1 of the Russian Consumer Rights Protection Law applies, the Buyer may withdraw from a distance purchase at any time before delivery and generally within 7 calendar days after receiving the goods.
8.2. If the legally required written explanation of how and when to return goods of proper quality was not provided at delivery, the withdrawal period may extend to 3 months after delivery.
8.3. Goods of proper quality may be returned when their saleable appearance and consumer properties are preserved; proof of purchase need not be limited to a receipt. The statutory exception for individually specified goods applies where the goods can be used exclusively by the particular Buyer. Cosmetics as a whole cannot be declared non-returnable solely because of their product category in distance selling; the actual condition, preservation of properties and applicable law are relevant.
8.4. Upon lawful withdrawal from goods of proper quality, the Seller refunds the sum paid for the goods, excluding lawful costs borne by the Seller to transport the returned goods from the Buyer, within 10 days of the Buyer's claim. Checking returned goods must be conducted fairly and cannot be used to extend the statutory refund period arbitrarily.
8.5. The Buyer may return goods remotely by carrier or postal service to 경기도 안산시 단원구 별망로 555, 4층 420호, Republic of Korea. The Buyer is encouraged to email orders@evacode.co.kr before shipping to receive logistical instructions and customs paperwork. Failure to seek prior approval does not extinguish a statutory return right. For returns of goods of proper quality, return-shipping costs and transit risks follow applicable law, including Russian Constitutional Court Resolution No. 7-P of 17 February 2026; if international return shipping would be economically disproportionate, the Seller must consider a reasonable accessible alternative in good faith.
8.6. If goods are defective or fail to meet the description, assortment, quantity or other mandatory terms, the Buyer enjoys the remedies established by Articles 18–24 of the Russian Consumer Rights Protection Law, including, as applicable, replacement, price reduction, correction of defects, refund and recovery of necessary costs. Such claims are not restricted to the ordinary 7-day withdrawal period for goods of proper quality.
8.7. The operational return process is described on the Returns page. If another language or local edition of that page contains narrower terms, Russian consumer transactions remain governed by statutory rights and this section; an unlawful restriction is ineffective.
9. Liability and protection of legitimate interests
9.1. The parties are responsible for breaches under applicable law. The Seller does not prospectively disclaim liabilities that cannot legally be limited in a consumer contract.
9.2. If damage or a defect is shown to result from the Buyer's misuse or improper storage, its consequences are assessed by reference to causation and the law. This does not remove the Seller's liability for pre-existing defects or failure to provide mandatory information.
9.3. Where there is a suspected unauthorized payment, disputed delivery or chargeback, the Seller may gather relevant evidence and contact payment providers or competent authorities on a lawful basis. Filing a complaint does not, by itself, amount to fraud.
9.4. External websites and services have their own terms; their involvement in performing the Seller's contract does not automatically release the Seller from its obligations.
10. Personal data, messages and Website content
10.1. Personal data processing is governed by the separate Personal Data Processing Policy and, for purposes requiring consent, the Personal Data Processing Consent, in accordance with Russian Federal Law No. 152-FZ.
10.2. Registration, placing an Order or accepting this offer does not constitute consent to promotional emails, SMS, transfers of personal data to independent advertising partners or optional tracking. Where required, consent is obtained separately and may be withdrawn in accordance with law.
10.3. Transactional messages about payment, confirmation, dispatch, delivery, product safety and refunds may be sent using the Buyer's contact information in order to perform the contract. Such communications must not contain unconsented advertising.
10.4. The Website may use strictly necessary cookies and identifiers for functionality and security. Analytics and advertising technologies are used in compliance with applicable notice and consent requirements. An IP address must not be assumed incapable of constituting personal data.
10.5. Rights in the texts, images and software elements of the Website belong to their lawful owners. Reuse is permitted only as allowed by law or the relevant rights holder.
11. Force majeure
11.1. A party prevented from performing an obligation by extraordinary and unavoidable circumstances may rely on such circumstances to the extent permitted by applicable law and subject to evidence of their impact on the relevant obligation.
11.2. Depending on the facts, such events may include natural disasters, extraordinary shipping restrictions, armed conflict and binding governmental measures. Shortage of funds, routine business difficulties or exchange-rate changes are not automatically force majeure.
11.3. The affected party informs the other where reasonably possible and takes reasonable steps to mitigate the effects. Force majeure does not eliminate mandatory consumer rights or remove lawful refund obligations.
12. Term, amendments and termination
12.1. A contract takes effect when formed under Section 4 and continues until obligations are fulfilled or it is lawfully terminated. Withdrawal and refunds are governed by Section 8 and mandatory law.
12.2. The Seller may update the published offer for future orders, stating the new version date. Amended terms cannot automatically be applied retrospectively to concluded or paid transactions to the Buyer's detriment.
12.3. Discontinuing a product does not remove obligations that have already arisen; the Seller must perform them or lawfully resolve any impossibility of performance with the Buyer.
13. Complaints, disputes and final provisions
13.1. The Buyer may submit an enquiry or claim to orders@evacode.co.kr, by telephone at +82 10-7652-8595, or by post to 경기도 안산시 단원구 별망로 555, 4층 420호, Republic of Korea. Providing an Order number, description and available evidence will help expedite a response; missing individual documents do not deprive consumers of statutory rights.
13.2. The legal deadlines for responding to and satisfying claims depend on the relevant Russian statutory remedy; an internal service deadline does not replace those deadlines. The parties may negotiate a resolution, without denying the Buyer's right to contact competent authorities and courts.
13.3. Where a sale targets the Russian consumer market and Article 1212 of the Russian Civil Code applies, these Terms do not deprive the Buyer of mandatory Russian consumer protections. International jurisdiction is determined under applicable legal rules, rather than by automatically designating Korean courts as the exclusive forum.
13.4. If a provision is unenforceable, the remaining Terms continue insofar as the law allows. Mandatory consumer rights are preserved in all cases.
